Registrul Auto Roman (Romanian Automobile registry) performs, by means of the MARKET SUPERVISION DEPARTMENT (MSD - DEPARTAMENTUL SUPRAVEGHERE PIATA - DSP), an intense activity of disciplining the profile market by running control and inspection actions performed by inspectors empowered by the Ministry of Transport and Infrastructure and working within the Market Supervision Department who follow the technical status monitoring of the car fleet and the conformity of the performed repair activities, in compliance with the technical and quality conditions imposed by the motor car builder, as well as the supervision of the road vehicle service market as regards the certification and/or approval of the equipment, spare parts and materials used in the road vehicles, resulting in insuring the traffic safety and the environment protection.
Due to the specific features of the control field, for certain actions performed by the RAR-MSD inspectors, they collaborate or answer to the requests expressed by other control bodies of the local public administration: the National Authority for Consumer’s Protection (NACP - Autoritatea Nationala pentru Protectia Consumatorilor - ANPC), the Internal Revenue Service, the Ministry of Labour by means of the Territorial Labour Inspectorate, specialized bodies within the Prefectures or the City Halls.
The control as regards the compliance with the regulations regarding the trading or use of road vehicles, of the equipment, spare parts and materials designed for them, the operation of the vehicle repair and reconstruction units, the technical inspection stations, as well as, as regards the compliance with the conditions for mounting, repairing, adjusting and checking the control devices in the road transports and the maximum speed governors and finding and penalizing the applicable infractions, are performed based on the existing legislative system, according to the Order no. 458/2006 of the Minister of Transports, Constructions and Tourism.
The control is performed by the personnel empowered by the Ministry of Transport and Infrastructure, employed within the Market Supervision Department based on the inspection and control ID.
In this context, the objectives of the control actions performed by the personnel empowered with this activity are mainly aimed at:
- checking the units providing road vehicle repair and maintenance services;
- checking the periodical technical inspection stations, where nonconformities were noticed;
- checking the service provision, mounting, checking, recording speed indicator and maximum speed governors repairing units;
- checking the LPG supply installation mounting and repairing units;
- checking the existence, with the manufacturers / importers of the certification and / or approval for all the road vehicle components;
- checking the equipment and spare part punching, as applicable, with the number of the certificate of conformity, mentioning the body performing the certification.
- analyzing, checking and solving the consumers’ claims and notifications regarding the quality of the road vehicle repair services or of the road vehicle products.
The results of the actions performed on the road vehicle component market and in the field of road vehicle repairs and maintenance can be quantified by the number, existing to date, of the partners in the road vehicle field which understood better and accepted that the compliance with the technical strict rules is supporting them, the traffic safety and the environment protection.
The measurement of the control act quality is made by its perception among the economic agents. The control act is performed, at the technical level, in very well determined legal framework, under demanding and rigorous conditions, the inspectors within the service answering directly and unequivocally to different situations, based on the technical, legal and communication knowledge acquired during 6 years of experience.
Therefore, from the technical point of view, the inspector provides information regarding:
- the product certification process;
- the licensing process for the units performing road vehicle repairing, adjustment, and check activities;
- the process of performing the motor vehicle technical inspection;
- the process of international approval of the road vehicle components, according to the ECE UN Regulation and to the European Directives;
and from the legal point of view, by the control act, the provisions of the legislation in the filed are applied and complied with.
The inspector insures, under any conditions, the stability and finality of the control act designed to contribute to the envisaged goal, with the respect and concern due to the provisions of the law and to the consumers’ safety.
The policy that the Romanian Automobile registry develops by means of the Market Supervision Department (MSD - Departamanetul Supraveghere de Piata - DSP) as regards the control activity is founded on the following general objectives:
1. to insure the efficiency of the market supervision designed to guarantee a high level of consumer protection.
2. to apply the existing road legislation, harmonized with the community acquis which imposes to check the compliance with it by performing control on the road vehicle product and service market at the manufacturers, importers, distributors, service providers.
3. to strengthen the consumer information and education activity.
